Commissions Terms of Service:
By starting the commission process, you are agreeing to the following:
Make big changes early on in the process to avoid fees
I take comms in batches - they are NOT always first-come-first-serve
The turnaround timer (TAT) starts when I tell you your piece is started, NOT when you submit payment
Usual TAT is 1-3 weeks - chronic illness may cause delays (you'll be told if that happens)
Listed prices are a starting point - final price depends on the project
You will get the chance to ask for changes at the sketch stage (and flat colors for color work) and at the end. More than 3 updated versions per revision stage may result in extra fees
Full payment is required to start project BUT sketch deposits and payment plans can be discussed
Full refunds only available until sketch sent, partial refunds after that
The artist retains the right to cancel at any point for any reason - you will get a refund in that case
You must give credit for public use - resale of art w/ characters is only allowed at original purchase price or less
The artist can use all commissions in their advertising/social media/portfolio (unless it is agreed to be kept private on both ends)
Images associated with The Art of MindSpice are NEVER to be shared with generative AI in ANY way
Commissions submitted with AI-generated reference material will be declined and the client blacklisted from future work
Adopts Terms of Service:
The artist retains the right to the base and art used in the original listing, and the right to use the design images in their portfolio
Purchase will transfer full ownership of the character, including design editing and reselling rights
BUT characters are NEVER to be used for profit or commercial purposes, and may only be resold for original purchase price (plus price of any additional art)
You must give credit for the art
Original art or characters are NEVER to be shared with AI in any way
Designs are stored on Toyhou.se and will be transferred there or listing privated if not transferred
Claimed designs will be held for 3 days for payment before being relisted
No refunds on adoptable sales
If you no longer want the character, please rehome them back to me instead of letting them rot away in a folder 💜
What to Expect:
Submit a form or DM me and we'll talk it over, I'll quote you a price breakdown, and you're added to the queue upon payment.
OR you can shortcut the process by purchasing via Ko-fi or Artistree and I'll reach out if I need any more info from you.
I'll let you know when you're at the front of the line and I'm getting started on yours - that's when the turnaround timer starts.
For full color work, you'll get to make changes at the sketch and flat color stages, as well as at the end, so keep an eye on your notifications.
For neon work, you'll get a chance to make changes at the sketch stage and at the end.
After any standing fees have been closed and you are satisfied with the work, you'll get a link to a Google Drive folder with the full resolution .png images - that link should not be shared with anyone else.

About Smudge:
Smudge is the mascot representing MindSpice.
They are a shapeshifter - an anthropomorphized charcoal smear - and they can be drawn however as long as they retain their glowing eyes and horns that curl around their pointy ears.
When small they're feisty and chaotic, but they assume a 'gentle giant' demeanor when they take a larger form.
They are often pictured with a shadowy African Painted Dog character named Blot. More about their adventures in The Void can be found in my Discord server.

MindSpice: A term coined to describe the art that comes from a mind inseparable from its unique conditions - be that trauma, neurodivergence, or curated skill.
The Art of MindSpice is an umbrella collective of character art and world-building. It is in the beginning stages of its development, but in the future it will include physical merchandise, a Patreon community, a running narrative, and unique species adoptables.
The Art of MindSpice also refers to the practice of priotizing one's wellbeing, boundaries, and self-discipline. It is a dedicated craft of breaking the cycle of old harmful patterns and creating a new cycle of nurturing energy. It is an art of embracing the present, meeting others where they stand, and being your own best friend and ally.
